Your Obligations

Tranche 2 Is Now in Effect: What Real Estate Agencies Need to Know

Real estate is considered a "very high and stable" vulnerability for money laundering in Australia. Since 1 July 2026, real estate agents and buyer's agents must be enrolled with AUSTRAC and have an active AML/CTF program in place before brokering the purchase, sale, or transfer of any property.

Your obligations cover both the buyer and the seller in every transaction.
Enrol with AUSTRAC and maintain a compliant AML/CTF program (required since 1 July 2026).
Conduct CDD on all vendors and purchasers before brokering any transaction.
Apply enhanced due diligence for high-value, offshore, or trust-structured buyers.
Manage Delayed CDD — including specific auction provisions up to 15 days post-exchange.
Report suspicious transactions to AUSTRAC via SMRs.
Maintain all records for the mandatory 7-year period.

Auction-Ready Delayed CDD

Don't let compliance kill an auction. AUSTRAC's Delayed CDD provision allows you to delay full counterparty verification until up to 15 days after the exchange of contracts. Lead AML tracks each party’s checks on the transaction, so nothing is missed.

Key Context

Compliance That Doesn't Slow Down Your Sales

Implementing compliance manually using AUSTRAC's 80+ page starter kits is a massive burden that takes your agents away from listing and selling. Lead AML digitises the entire process — so your team spends time with clients, not paperwork.

How We Help

Instant Buyer KYC and Name Screening

Mobile-Friendly Vendor & Buyer KYC

Fast, template-driven identity verification workflows that your salespeople can use on the go — at the property, in the office, or at auction.

Auction-Ready Delayed CDD

Track every party’s checks on the transaction while you use AUSTRAC’s "Delayed CDD" provisions, which can allow verification up to 15 days after the exchange of contracts.

Unpacking Trusts & Offshore Buyers

Identify and verify the Ultimate Beneficial Owners (UBOs) behind complex family trusts, self-managed super funds (SMSFs), and offshore shell companies purchasing real estate.

Risk Ratings That Catch Red Flags

The customer risk assessment covers high-risk scenarios, such as unfinanced purchases over $1.5 million or deposits paid in large sums of physical cash.

Audit-Ready Record Keeping

Ensure every ID check, PEP screen, and risk assessment is securely logged in the cloud for the mandatory 7-year period.

AML for real estate agents: FAQs

Are real estate agents covered by Tranche 2?

Yes, when brokering the sale, purchase or transfer of real estate. Property management and residential leasing aren’t designated services.

Do I verify the buyer, the seller or both?

Both. When you broker a sale, purchase or transfer, your obligations cover the buyer and the seller. AUSTRAC’s real estate guidance explains the timing, including when buyer verification can be completed after exchange.

How do I check a buyer that is a trust or company?

Identify and verify the individuals who own 25% or more or control it. Lead AML’s business check confirms the entity with the ABR and ASIC and asks it to declare its owners, who each get an ID check.

How much does AML software for real estate agents cost?

Lead AML plans start at $79 a month (plus GST), with monthly credit for automated ID and business checks and the AML/CTF program builder included. You can try every Growth feature free for 14 days, no card needed.
